Neden SGK Robotics?

İş Göremezlik Rapor Onayı

SGK e-vizite ekranına düşen veya çalışanların manuel olarak ilettiği iş göremezlik raporlarının sistem girişi ya da işveren onayının 5 gün içerisinde yapılması yasal zorunluluktur. Bu süre doğrultusunda ilgili işlemler yapılmaz ise idari para cezai gelmektedir.

(5510 sayılı Sosyal Sigortalar ve Genel Sağlık Sigortası kanununa göre 4üncü maddenin birinci fıkrasının (a) bendi kapsamındaki (4/a – işçi) sigortalılara geçici iş göremezlik ödeneği ödemelerinde 100üncü maddeye istinaden kurumca işverenlerden istenilen bildirimlerin (istirahatlı olan sigortalının işyerinde çalışmadığına dair bildirimin) belirlenen süre içerisinde (sigortalılarca hak edilen istirahat süresini takip eden 5 iş günü içinde) ve elektronik ortamda yapılmaması halinde sigortalı başına aylık asgari ücretin onda biri, hiç yapılmaması halinde ise sigortalı başına aylık asgari ücretin yarısı tutarında idari para cezası uygulanır.)
SGK e- vizite ekranını hangi sıklıkla kontrol etmeliyiz?

Bildirge verilirken tüm çalışanlar için ayrım yapmaksızın istirahatlidir alanı işaretleniyor ise yasal olan yükümlülük yerine getirilmiş olmaktadır. Ancak çalışanların geçmiş dönemlere ait iş göremezlik raporları sisteme geç düşebilmektedir bu durum cezai risk doğurur. Çalışanların iş göremezlik ödeneklerinin kesintisi yapılıyor ise kesinti süreci nasıl olursa olsun çalışanları mağdur etmemek adına raporlar geciktirilmeden onaylanmalıdır. Ödenekleri çıkmadan maaşlarından kesintinin yapılması doğru/etik değildir. Çalışanlardan bu doğrultuda sürekli geri dönüş alınmaktadır. Örneğin; çalışanınız 15 Haziran ile 15 Ağustos arası iş göremezlik raporu aldı bildirgeler her ayın 23’ üne kadar verildiği için bu tarihe kadar onay süreci var olarak ay sonu düşünülebilir ancak bildirgelerin erken verildiği durumda cezai risk doğurur. Cezai sürece girmemek için iş göremezlik raporlarının en az haftada bir defa düzenli olarak. kontrol edilmesi gerekmektedir.
